FAQ

Frequently asked questions

What does a conveyancer do?

A conveyancer manages the legal side of a property transaction: reviewing the contract of sale, checking the title and doing the required searches, preparing or reviewing the documentation, calculating adjustments such as rates and taxes, and managing settlement so the property transfers into your name correctly.

Do I need a conveyancer to buy or sell property in Victoria?

You are not legally required to use one, but buying or selling property involves contract, title and settlement work that carries real risk if it is done wrong. Most Victorian buyers and sellers engage a conveyancer or solicitor to handle it.

When should I engage a conveyancer?

Before you sign anything. For a purchase, have the contract reviewed before you sign it. If you are buying at auction, arrange the review before auction day, because a successful bid is unconditional.

How much does conveyancing cost?

Fees depend on the type of matter, the title and what is involved. We quote each matter on its own scope, so call us on (03) 5783 1655 and we will give you a clear figure up front.

How long does settlement take in Victoria?

The settlement date is agreed between the buyer and seller and is usually set at 30, 60 or 90 days from the contract date. How long the whole matter takes depends on the searches, any conditions in the contract and the lender's readiness.

What is PEXA and does it change anything for me?

PEXA is the electronic platform used for lodging and settling property transactions in Victoria. Settlements are completed online, which is faster and removes the need for paper documents to be physically exchanged on settlement day.

Can you help with subdivision, transfers between family members, or a lost title?

Yes. Along with purchases and sales, we handle subdivisions, related party transfers, applications by surviving proprietors and legal personal representatives, and lost or replacement title applications.

Do you work with buyers and sellers across the region?

We are based in Wallan and act for clients across the surrounding towns and districts, as well as wider Victoria through the Sargeants group. Call us on (03) 5783 1655 to discuss your matter.

3. Sources of personal information

We collect information directly from you, including contact, demographic and financial information, when you fill out a form on the site, sign up for communications, or ask us to contact you.

We collect information from our service providers, such as analytics software we use to measure and analyse traffic to the site and interaction with our ads. Our service providers may capture usage data to provide and analyse a session replay of your activities on the site, which may record clicks, mouse movements, scrolling, typing, navigation through the site and the technical specifications of your device.

We collect information from other third party sources, including information you make publicly available on social media or other resources, or when you give us consent to link your account to a third party service or provider.

We collect information passively from you using tools like browser cookies, as described in the cookies section below.

4. Categories of third parties we share personal information with

Service providers. From time to time we may establish a business relationship with other businesses we believe are trustworthy and who have confirmed their privacy practices are consistent with ours (service providers). For example, we may contract service providers for hosting and maintenance, data storage and management, and marketing and promotions. We only provide them with the information necessary for them to perform those services on our behalf. Each service provider must agree to use reasonable security procedures and practices appropriate to the nature of the information involved to protect your personal information from unauthorised access, use or disclosure. Service providers are prohibited from using personal information other than as specified by us.

Our affiliates. We may share personal information with businesses controlling, controlled by, or under common control with us, where those affiliates are acting as our service provider, or where required by law.

Third party advertising partners. We may share personal information with third parties such as advertising networks, social media platforms and measurement or analytics partners to show you targeted advertising across the different websites, apps and devices you use (sometimes called cross-contextual behavioural advertising), and to provide analytics, attribution and reporting. This may include identifiers and other identifying information such as name, email address, phone number, online identifiers, cookie IDs and mobile advertising IDs, geolocation information, commercial information, and internet or other electronic network activity information. In some cases we may share contact information such as your email address with these partners so they can match it to their users and create custom audiences and similar segments.

Corporate transactions. If we merge, are acquired or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer personal information in connection with that transaction.

Compliance with laws and law enforcement. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose personal information if, in our discretion, we believe it is necessary or appropriate to respond to legal requests (including court orders and subpoenas), to protect the safety, property or rights of our business or of any third party, to prevent or stop any illegal, unethical or legally actionable activity, or to comply with the law.

5. Privacy notice specific to mobile messaging

We will only use information you provide when opting into mobile messaging (the program) to transmit your mobile messages and respond to you if necessary. We do not sell, rent, loan, trade, lease or otherwise transfer any phone numbers or customer information collected through the program to any third party for that third party's marketing purposes or otherwise for that third party's own benefit. We nonetheless reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This section is strictly limited to the program and has no effect on the other provisions of this Privacy Policy.

6. Cookies

We may use cookies (a small text file placed on your computer to identify your computer and web browser) and anonymous identifiers (a random string of characters used for the same purposes as a cookie). We may use cookies and similar technologies to analyse use of and improve the site and services, and as described in the advertising and online tracking section. Most web browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent, however certain features of the site or services may not work if you delete or disable cookies. Some of our service providers may use their own cookies, anonymous identifiers or other tracking technology in connection with the services they perform on our behalf.

We may use Google Analytics on the site and services to analyse how users use the site and services, and to provide advertisements to you on other websites. For more information about how to opt out of having your information used by Google Analytics, visit tools.google.com/dlpage/gaoptout.

7. Session replay technology

We use session replay technology on our site. Session replay technology, also referred to as session playback or user experience (UX) replay, collects information regarding and tracks your interactions with a website or application, then transforms those logged user events (such as mouse movements, clicks, page visits, scrolling and tapping) into a reproduction of what you actually did. We use session replays for quality control, customer service, fraud prevention and security, and marketing purposes. Our session replay technology is owned and operated by a third party who acts as our service provider. The information collected by this technology may be collected by, transferred to, and stored by our third party service provider.

8. Chatbot technology

We use chatbots to help provide customer service and support, including through the use of a virtual assistant. A chatbot is a software application that mimics human conversations in text or voice interactions on our website or through our customer service hotline. The chatbot is designed to work without the assistance of a human operator, and responds to questions posed to it in natural language using a combination of pre-programmed scripts and machine learning algorithms. If the conversation introduces a concept it is not programmed to understand, it will pass it to a human operator. If you use our chatbot service, we will collect any information you provide to us. We will also create and store a transcript of your chat interaction, which will be shared with and stored by our third party service provider. We use these transcripts and the information you provide for quality control, customer service, fraud prevention and security.

9. AI voice assistant

Certain telephone numbers we provide for use on our website or in our advertising may be answered, in whole or in part, by an artificial intelligence powered voice assistant rather than by a live person. If your call is answered by an AI voice assistant, you will be notified at the start of the call that you are speaking with an artificial intelligence assistant and not a live person. Depending on how it has been configured, it may ask you questions, respond to your questions, collect information you provide during the call (such as your name, contact information and the reason for your call), and assist with scheduling or directing your call. If you use the AI voice assistant, we will collect the information you provide during the call, along with a recording and or transcript of the call. This information will be shared with and processed by our third party service provider that operates the technology on our behalf. We use this information for the same purposes described elsewhere in this Privacy Policy, including to provide and improve the services, for quality control and customer service, and for security and fraud prevention.

10. Advertising and online tracking

We may place advertisements and allow third party companies to serve ads and collect certain information when you visit the site. These companies may use certain information (such as click stream information, web browser type, time and date, and the subject of advertisements clicked or scrolled over) during your visits to this site and other websites in order to provide advertisements about goods and services likely to be of interest to you, including to show you targeted advertising across the different websites, apps and devices you use. We may provide these companies with information we have collected about you, such as your email address or other contact information in hashed or other de-identified form where supported, to help them recognise you across devices and deliver interest based advertising, including by creating custom audiences or similar matched audience segments on third party platforms.

These companies may also collect information about your activities on our site on your current device and combine it with information about your activities on other websites, mobile apps and devices. They typically collect this information using server logs, cookies, web beacons, tags, pixels, mobile advertising IDs (such as Facebook cookies or Google's Advertising ID), cross-device linking and similar technologies, and may match your browsers or devices if you log into the same online service on multiple devices or if your devices share similar attributes.

Our systems do not recognise browser Do Not Track signals, but several of our service providers who utilise these cookies on this site enable you to opt out of targeted advertising practices. To learn more, or to opt out of this type of advertising, you can visit networkadvertising.org or aboutads.info/choices. Options you make are device specific.

11. Managing your information preferences

You can opt out of receiving marketing emails from us by following the link provided at the bottom of all marketing emails you receive from us. You are able to opt out of marketing emails, however you cannot opt out of receiving all emails from us, such as emails about the status of your account.

12. Be careful when you share information with others

Please be aware that whenever you share information on any public area of the site or services, that information may be accessed by others. When you share information in other communications with third parties, that information may be passed along or made public by others, which means anyone with access to it can potentially use it for any purpose, including sending unsolicited communications. We cannot control and are not responsible for what such third parties may do with your information, so you should exercise caution when choosing to share it.

13. Security

We maintain physical, electronic and procedural safeguards to help protect the confidentiality and security of information transmitted to us. Personal information may be accessed by persons within our organisation, or other entities described in this Privacy Policy, or our third party service providers, who require such access to carry out the purposes described in this Privacy Policy, or as otherwise permitted or required by applicable law.

However, no data transmission over the internet or other network can be guaranteed to be 100% secure, and no security measures can provide absolute protection. As a result, while we strive to protect information transmitted on or through the site or services, we cannot and do not guarantee the security of any information you transmit, or that you otherwise provide to us, and you do so at your own risk.

14. Links

Our site and services may contain links to other websites, or allow others to send you such links. A link to a third party's website does not mean that we endorse it or that we are affiliated with it. We do not exercise control over third party websites and are not responsible for their practices. You access such third party websites or content at your own risk. You should always read the privacy policy of a third party website before providing any information to it.

15. Children's privacy

The site and the services are intended for and directed to a general adult audience. We do not knowingly collect personal information from children under the age of 16. If we become aware that we have inadvertently received personal information from a child, we will delete such information from our records.

16. Overseas transfers

Please be aware that your personal information and communications may be transferred to and maintained on servers or databases located outside of Australia. We may process and store information overseas, including in the United States.

17. Privacy policy changes

We may change this Privacy Policy from time to time. If we decide to change it, we will inform you by posting the revised Privacy Policy on the site. Those changes go into effect on the revised date shown. By continuing to use the site or services, you are consenting to the revised Privacy Policy.

18. Access and correction

If you would like to access or correct your information in our records, please contact us using the contact information available on the site. We will promptly respond to your request.

19. How to contact us and complaints

If you have any questions regarding this Privacy Policy, or concerns about the management of your personal information, you may contact us using the contact information available on the site. We will aim to investigate and resolve your complaint as soon as possible, usually within 30 days of receiving it. If you are not satisfied with our response, you may lodge a formal complaint with the Office of the Australian Information Commissioner at oaic.gov.au. Please print a copy of this Privacy Policy for your records, and check the site frequently for any changes.
